About This Settlement

GlaxoSmithKline (GSK) was alleged to have misled consumers through its 'Big Bad Cough' advertising campaign, which allegedly misrepresented Boostrix's ability to prevent whooping cough from spreading to others. Plaintiffs alleged they would not have purchased the pertussis vaccination had they known the truth about its alleged effectiveness. Who Qualifies

• You may be eligible to participate in this settlement if you meet all of the following criteria:
• You are an adult who viewed GlaxoSmithKline's 'Big Bad Cough' advertising campaign between May 20, 2016, and May 20, 2020
• At the time you viewed the campaign, you either lived in New York, OR you were vaccinated with Boostrix in New York during that same period
• You received the Boostrix (pertussis) vaccination during the eligible timeframe
• You can provide either a qualifying proof of vaccination (a vaccination record including your name, date of vaccination, and vaccine name) OR submit a signed attestation confirming you received the vaccination

What You May Receive

Eligible claimants may receive up to $50 if you submit a qualifying proof of vaccination (a vaccination record that includes your name, the date of vaccination, and the vaccine name). If you do not have qualifying proof of vaccination but can submit a signed attestation confirming you received the Boostrix vaccine, you may receive an estimated $10. Final payout amounts are not guaranteed and the total settlement amount has not been publicly disclosed.

3. Provide your supporting documentation: submit a qualifying proof of vaccination — a vaccination record that includes your name, date of vaccination, and the vaccine name — to be eligible for up to $50. If you do not have qualifying proof, submit a signed attestation of vaccination to be eligible for an estimated $10.
4. Submit your completed claim form and documentation by the claim deadline of June 8, 2026. Late submissions may not be accepted.
